Terms of Service

You must be at least 18 years old to use Fazool. By using the Service you represent and warrant that:

• You are at least 18 years of age.
• You have the legal capacity to enter into a binding agreement.
• You are not prohibited from using the Service under applicable law.
• You have never been convicted of a felony, a sex crime, or any crime involving violence.
• You are not required to register as a sex offender with any government entity.

Fazool reserves the right to verify your eligibility at any time. Providing false information about your age or identity is grounds for immediate termination of your account.

To use Fazool you must create an account. You agree to provide accurate, current, and complete information and to update it as necessary. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access. Fazool is not liable for any loss arising from unauthorized use of your account.

You may not create more than one account. Accounts are non-transferable. We reserve the right to terminate duplicate accounts.

Fazool requires users to verify their identity by submitting a government-issued photo ID ("ID Verification"). Verification is required before accessing the discovery feed. You agree that:

• The ID you submit is genuine and belongs to you.
• You will not submit altered, forged, or another person's ID.
• Submitted ID images may be reviewed by human moderators and processed using automated tools to extract and verify name, date of birth, and ID number.
• Extracted data is stored in hashed or encrypted form and is not sold to third parties.

"User Content" means any photos, text, audio, video, or other material you upload or transmit through the Service. You retain ownership of your User Content, but you grant Fazool a worldwide, non-exclusive, royalty-free, sublicensable license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute your User Content for the purpose of operating and improving the Service.

By submitting User Content you represent and warrant that:

• You own or have the necessary rights to the content.
• The content does not infringe any third-party intellectual property or privacy rights.
• The content complies with these Terms and all applicable laws.
• Photos depict only you and are recent, accurate likenesses.

All User Content is subject to review. We may remove content that violates these Terms without prior notice. Photos are reviewed before being shown to other users.

You agree not to, and will not assist others to:

• Create a fake profile or misrepresent your identity, age, or intentions.
• Use the Service for commercial purposes, advertising, or solicitation without our consent.
• Harass, bully, stalk, intimidate, threaten, or harm any other user.
• Post or transmit nudity, sexually explicit content, hate speech, or content that promotes violence.
• Solicit money from other users or engage in scam behavior.
• Share another user's personal information without their consent ("doxxing").
• Use the Service while operating a vehicle or in any manner that creates a safety risk.
• Attempt to gain unauthorized access to accounts, systems, or networks.
• Use automated scripts, bots, or crawlers to access the Service.
• Reverse engineer, decompile, or disassemble any portion of the Service.
• Use the Service in any way that violates applicable local, state, national, or international law or regulation.

Violations may result in immediate account suspension or termination, and may be reported to law enforcement.

We care deeply about safety, but we are not responsible for the conduct of users on or off the Service. You are solely responsible for your interactions with other users. While Fazool performs identity verification, we do not conduct criminal background checks. We encourage you to:

• Meet in public places for first meetings.
• Tell a friend or family member where you are going.
• Not share financial information with matches.
• Report suspicious or unsafe behavior using the in-app reporting tools.

Fazool provides an optional Wali (chaperone) feature that allows users to invite a trusted family member or guardian to monitor their profile and conversations in accordance with Islamic principles.

• You may invite up to 3 Wali accounts at any time. Wali invitations are subject to the active chaperone limit enforced by the Service.
• Wali accounts have read-only access only. They may view your profile, approved photos, match inbox, and message history. They cannot send messages, swipe, or take any action on your behalf.
• Wali accounts are subject to the same community standards and Prohibited Conduct rules set out in Section 5 of these Terms. Misuse of Wali access (e.g., sharing screenshots, harassing the user's matches) may result in termination of the Wali account.
• Invite links expire after 1 hour. You may resend an invite to generate a new link.
• Both you (the user) and your Wali must comply with all applicable sections of these Terms. You are responsible for ensuring that any Wali you invite understands and agrees to abide by these Terms.
• Wali accounts are automatically removed when you remove them via Settings or when you delete your own account.

Fazool offers free and paid subscription tiers. Paid features are available through a recurring subscription. By subscribing you agree:

• Subscription fees are billed in advance on a recurring basis (monthly or annually).
• Your subscription renews automatically unless cancelled before the renewal date.
• To cancel, use the in-app settings, your Apple App Store account, your Google Play account, or contact [email protected].
• Refunds are issued at Fazool's discretion, except where required by applicable law. Apple and Google in-app purchases are subject to their respective refund policies.
• We may change subscription prices with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new price.

Free trials (where offered) will convert to a paid subscription at the end of the trial period unless cancelled before the trial ends. You will not be charged during the trial period.

Fazool and its licensors own all right, title, and interest in the Service, including all software, design, text, graphics, logos, and trademarks. Nothing in these Terms grants you any right to use Fazool's trademarks, logos, domain names, or other distinctive brand features. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FAZOOL DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

FAZOOL DOES NOT GUARANTEE THAT YOU WILL FIND A MATCH, PARTNER, OR ANY PARTICULAR OUTCOME FROM USING THE SERVICE. RESULTS VARY AND ARE NOT GUARANTEED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FAZOOL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF FAZOOL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL FAZOOL'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FAZOOL IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

You agree to defend, indemnify, and hold harmless Fazool and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including any content you submit or any interactions you have with other users.

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration rather than in court, except for claims that qualify for small claims court. You and Fazool each waive the right to a jury trial and to participate in any class action or representative proceeding.

Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in the county where you reside or via telephone or video conference. The arbitrator's award will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

You have 30 days from the date these Terms become effective to opt out of arbitration by sending written notice to [email protected]. If you opt out, all disputes will be resolved in the courts of Travis County, Texas.

These Terms and any disputes arising under them shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions. Subject to the arbitration agreement above, you consent to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas.

You may delete your account at any time through the app settings. Fazool may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 9, 10, 11, 12, 13, and 14 survive termination.

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material changes, send you a notification via email or in-app notice at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
